1. Agreement to terms

These Terms of Use (“Terms”) govern your access to and use of the websites, forms, and related online services operated by Lazarus LLC, a Wyoming limited liability company (“BuilderRates,” “we,” “us,” or “our”), including without limitation the site located at our primary domain and any successor or affiliated domains (collectively, the “Site”). By accessing or using the Site, you agree to these Terms and our Privacy Policy and Cookie Policy, each incorporated by reference. If you do not agree, do not use the Site.

2. Eligibility

You represent that you are at least eighteen (18) years of age and have legal capacity to enter binding contracts. If you use the Site on behalf of an entity, you represent that you have authority to bind that entity.

3. Nature of services

BuilderRates provides marketing, educational content, and business introduction services. We are not a lender, broker-dealer, investment adviser, or law firm. We do not extend credit, underwrite loans, or guarantee that any lender will make an offer. Any financing is subject to separate agreements between you and third-party lenders. Nothing on the Site constitutes an offer to lend or an offer of securities.

Information on the Site is for general informational purposes only and is not tax, legal, accounting, or investment advice. You should consult qualified professionals regarding your specific situation.

5. User conduct

You agree not to misuse the Site, including by attempting to gain unauthorized access, introducing malware, scraping in violation of these Terms, harassing our personnel or partners, or submitting false or misleading information. We may suspend or terminate access for violations.

The Site and its content (including text, graphics, logos, and layout) are owned by BuilderRates or our licensors and are protected by copyright, trademark, and other laws. Except for limited browsing and sharing as permitted by law, you may not copy, modify, distribute, or create derivative works without our prior written consent.

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BUILDERRATES AND ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNTS YOU PAID TO US (IF ANY) FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE (12) MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Indemnity

You will defend, indemnify, and hold harmless BuilderRates and its affiliates, officers, directors, members, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third-party rights.

11. Governing law and venue

These Terms are governed by the laws of the State of Wyoming, excluding conflict-of-law principles. Subject to applicable mandatory arbitration or small-claims provisions, you and BuilderRates consent to the exclusive jurisdiction and venue of the state courts located in Sheridan County, Wyoming, and the United States District Court for the District of Wyoming, for any dispute not subject to arbitration.

12. Dispute resolution

Before filing a claim, you agree to contact us at hello@builderrates.com to attempt informal resolution. If the dispute cannot be resolved informally within sixty (60) days, either party may pursue remedies in accordance with Section 11, unless you and we agree in a separate signed writing to arbitration on different terms.

13. Changes

We may modify these Terms at any time by posting an updated version on the Site. Your continued use after the effective date constitutes acceptance. Material changes may be highlighted on the Site or communicated by email where appropriate.
